EarnPark and the EU Markets in Crypto-Assets Regulation (MiCA)

Our current regulatory position

EarnPark is operated by a company incorporated in the British Virgin Islands and maintains a corporate presence in the United Kingdom. It is not established in the European Union. MiCA applies to crypto-asset service providers that are established in the EU or that actively direct their services at clients in the EU.

EarnPark does not conduct marketing or promotional activities targeted at the European Union or its residents. Where clients located in the EU engage our services exclusively at their own initiative, a principle expressly recognized under MiCA's art.61 as "reverse solicitation", those services fall outside the scope of the authorization requirement.

Accordingly, EarnPark is not currently required to hold a MiCA authorization, and our services remain fully available to all existing clients without interruption. No changes to your account, assets, or strategies are required as a result of MiCA taking effect.


Looking ahead: our path to MiCA authorization

While authorization is not required for our current operating model, we believe Europe is an important market and that regulatory licensing is the right long-term foundation for growth. We want to market in Europe. Therefore, we are preparing to establish an EU-based entity and pursue MiCA authorization as a Crypto-Asset Service Provider (CASP). This is a deliberate, proactive step, driven by our ambition to serve European clients at greater scale.

We will share updates on jurisdiction, timeline, and progress as this process advances.


Clients outside the scope of MiCA

MiCA applies within the European Union and the European Economic Area. Clients in jurisdictions outside its scope are unaffected.
